Daniel Weltin attended the University of California at Berkeley. Before opening a San Leandro office to focus on personal injury and workers’ compensation cases, Mr. Weltin graduated from Santa Clara University School of Law. While in law school he worked as a law clerk at Weltin • Streb & Weltin LLP. Mr. Weltin speaks fluent Spanish and Portuguese. He is licensed to practice before the State and Federal Courts of California and Hawaii. He is an experienced trial lawyer. Mr. Weltin is an active member in several professional organizations, including the American Association for Justice, the Consumer Attorneys Of California and the San Francisco Trial Lawyers Association.
Since starting to practice law in 2003, Mr. Weltin has been involved in all aspects of California and Federal civil litigation through trial and appeal. Since 2004, Mr. Weltin has been extensively involved in all aspects of complex litigation in Alameda, Santa Clara and San Francisco counties. He is a member of the California, Hawaii and Texas bars. Mr. Weltin was named a SuperLawyer Rising Star from 2012-2016. He was named Top 40 under 40 and Top 100 by the National Trial Lawyers.
Mr. Weltin handles catastrophic personal injury cases. In 2017, one such case settled for $8 million. Harris v. Alameda Contra Costa Transit District (RG15772148). Other results include a slip and fall injury settlement during jury selection for $3 million. Mr. Weltin has resolved multiple other personal injury and workers’ compensation lawsuits in the six- and seven-figure ranges.
Mr. Weltin also is experienced with complex litigation. He has handled and resolved complex multi-plaintiff wage and hour lawsuits and a multi-plaintiff toxic tort lawsuit. In 2012,he was certified as co-lead class counsel in a complex wage and hour matter in Alameda County. See Oracle Wage and Hour Cases, JCCP 4597 (Garcia v. Oracle, RG07-321026). In 2013, Mr. Weltin was certified as class counsel in the Castillo et al. v. Capaz Construction Corp. et al. and its companion case Hernandez et al. v. Capaz Construction Corp. (RG06290188), after a successful appeal regarding Labor Code § 2810. Castillo v. Toll Bros., Inc., (2011) 197 C.A. 4th 1172. In 2020, Mr. Weltin received approval for a PAGA (Private Attorney General Act) settlement in the matter of Martinezv. UltraEx, Inc., et al. (RG18928105). In 2021, as co-lead counsel he certified and resolved a class of hotel housekeepers in Sosa v. Marriott International, Inc. (18CV335342).
In addition to fighting for justice for injured people, Mr. Weltin enjoys spending time with his family, running and travelling.
He has secured more than 700 settlements, certified three group actions, and prevailed in three jury trials. In addition to his work on personal injury cases, Mr. Weltin was certified as the class’s lead counsel in cases against the Fortune 500 companies. The case against Oracle resulted in a $35 million settlement. He argued successfully for the appeal decision in a collective wage-and-hour action that resulted in an agreement for nearly 2,000 residential construction workers. He also handled the appeal case that gave day laborers the right to sue homeowners in California if a worker is injured in the first few days of work.
